GENERAL TERMS
General terms and conditions for freight forwarding services
- These General Terms and Conditions arrange the standard content of contracts for forwarding services between “AVE Bulgaria Logistics” OOD, BG203003174, with registered office and management address in Sofia, Malinova Dolina 29, and its clients.
- Upon request for a forwarding service from “AVE Bulgaria Logistics” Ltd., you conclude a contract with “AVE Bulgaria Logistics” Ltd., consisting of these general terms and conditions, supplemented by the specific terms and conditions for the type of transport, as well as from a delivery confirmation prepared according to the client’s instructions in cases of organizing transport, including delivery to an address of import and/or export shipments via land, air and sea transport.
- Depending on the type of transport, “AVE Bulgaria Logistics” Ltd. operates according to the following specific terms and conditions:
А. Specific terms and conditions sea transport:
- In case of damage or loss, our liability is limited to the amount specified in the Hague-Visby Rules 2 SDR (approximately 2.4 EUR per kilogram). For more expensive cargo, we recommend taking out additional cargo insurance.
- The offer is with available spaces and equipment at the time of sending the rate. If the offer is confirmed on a subsequent day, it is subject to reconfirmation by us, according to the remaining spaces and equipment at the date of the request.
- All offers are “subject to space and equipment”, PSS and GRI and other extraordinary fees introduced by the shipping line during the transport.
- “AVE Bulgaria Logistics” Ltd. reserves the right to change the indicated terminal fees and/or the rate for delivery if changes occur during transit.
- Unloading and releasing time of the container is limited to 5 hours. If this period is exceeded, “AVE Bulgaria Logistics” Ltd. has the right to charge the client a container detention fee as follows – EUR 100.- for the first day and EUR 125.- for each additional day.
- In cases where the client organizes customs clearance of the goods himself, the transit issued for the respective shipment should be closed no later than the day following the day of unloading. In cases where the transit is not closed within this period, “AVE Bulgaria Logistics” Ltd. will charge a fee of 15 euros per day for goods worth up to 25,000 dollars and 30 euro per day for goods worth over 25,000 dollars. If customs clearance is performed by “AVE Bulgaria Logistics” Ltd., such late fees are not applicable.
- The dollar-eur exchange rates we use are as follows: upon arrival at Bulgarian ports – at the rate sold by Unicredit /exception for Maersk Line, where we use the line’s exchange rate/, and upon arrival at Greek ports at the rate used by the shipping line’s representative office in Greece.
- The indicated amounts in foreign currency are for informational purposes only, as they are converted into Euro at the exchange rate on the date of issuance of the invoice itself.
- Payments on invoices issued by “AVE Bulgaria Logistics” Ltd. are made in EUR or USD, with the currency values on the invoice itself being confirmation that they correspond to the initial offer accepted by you.
- The price of the service for delivering your shipment from a port at the destination to the final delivery address is calculated based on the price of fuel on the date the offer is sent. If there is an increase in the price of fuel by at least 5% on the date of arrival of the container at the respective unloading port, “AVE Bulgaria Logistics” Ltd. reserves the right to change the price of this service.
- If you confirm a request with a cancellation fee and subsequently cancel after receiving written confirmation, this fee will be invoiced separately.
- For shipments weighing over 22,000 kg, the offer is subject to additional confirmation by us and a possible change in the price according to the weight of the cargo.
Б. Specific terms and conditions air transport:
- In case of damage or loss, our liability is limited to the Montreal Convention 19 SDRs (approximately 23 EUR per kilogram). For more expensive cargo, we recommend taking out additional cargo insurance.
- Rates are based on weights, pieces, dimensions, and commodity description provided and are subject to verification.
- Rates quoted reflect market conditions as of the date of the quote and are subject to fuel surcharge and currency exchange rate fluctuations.
- Rates are based on space and equipment availability and are subject to carriers of our choice.
- Rates are valid for turn able, stackable, forklift able, non-batteries, non-DG, non-magnets, non-liquids, non-temperature regime, non-excise, non-double used goods, normal cargo, shipper, consignee – companies, origin out of EU, destination airport Sofia/ SOF, value up to 20000 EUR, processing in working days, hours.
- Transit times indicated are estimates only and are not guaranteed.
- Unless specified, rates are based on general stackable cargo.
- For special cargo please additionally charges will apply, on request.
- Special cargo-if any of the below codes is shown on FWB or packaging : BIG, HEA,DGR, ICE, RRE, REQ, AVI, AVF, VUN, VAL, HEG, LHO, MUW, PER, COL, FRO, PEM, PES, PEF, PEP, Eli, ELM or gross weight per single piece is over 150 kgs.
- Cargo should be properly packed and suitable for transportation, ready for carriage.
- All wood packaging (including dunnage) must be in accordance with ISPM #15 regulations, evidenced by the IPPC symbol. Failure to comply with this requirement may lead to excessive delays and additional costs.
- Please allow for appropriate lead time to ensure space and equipment availability.
- EXW/DAP rates are based for regular business hours with max 30 min standing time for pick up/delivery. If special requirements are applicable (tailgate, special handover, etc) there will be additional charges.
- Above rates are valid only if we get information about the airline that you are planning to use in advance in order to send you AWB instructions. AWB instructions must be kept in order to keep above offered rates. In case of discrepancy with the AWB instructions additional charges may apply.
- No free days of storage are included at rates – in case we must store the cargo please send specific request.
- AVE Bulgaria Logistics’ liability is limited by the Montreal convention for the air movements and CMR convention for the movements on the road. In no case shall our liability exceed these limitations.
В. Specific terms and conditions road transport:
- AVE Bulgaria’s liability is subject to the limitations set out in the WC, MC, CMR, CIM or the terms and conditions on the B/L. Further declaration of cargo values at transport orders, invoices or any other documents determine according to our services on the basis of the NSBS General Forwarders Terms and Conditions no increase of our limitation of liability. There is no transport/marine insurance automatically covered for your shipment. In many cases there is no liability of carriers, e.g. natural disaster or General Average. We recommend additional transport insurance (premium, procurement, handling), (optional door-to-door coverage), covering damages at on- and offloading, general average deposit payment and in case of damage/loss up to full cargo value.
- Organized transports by AVE Bulgaria are based on the conditions in the CMR Convention. In case of cargo damage, our liability is limited to those mentioned in the Convention CMR 8.33 SDR (about 10 EUR per kilogram). For expensive goods transported we recommend an additional cargo insurance to be issued.
- The current offer is valid in condition that the both addresses have access for heavyweight truck compositions. In the absence of such, for extra charge, we can arrange the lifting / unloading of the goods with a small truck and trans-shipment in our controlled warehouse.
- If there is a change in the shipment’s parameters, we have the right to change the transport costs.
- Upon confirmation of the transport order and cancellation 24 hours before loading date AVE Bulgaria is charging 30% of agreed transport rate. Upon confirmation of the transport order and cancellation on the loading date AVE Bulgaria is charging 75% of agreed transport rate.
- Free loading/unloading times: 4 hours per address for LTL/FTL at EU countries; 6 hours per address for LTL and 24 hours per address for FTL at non EU countries. If loading/unloading free times are not kept AVE Bulgaria is charging per started 24 hours period following: min 30 EUR per hour or max 250 EUR per day.
- This offer applies to general cargo, excluding dangerous goods, cargo under customs regime or those requiring temperature control. When the shipment exceeds 100 000 EUR, the offer is subjected to further confirmation.
- AVE Bulgaria will not send originals of CMP / POD and commercial documents. Please note that after the transport is completed, all necessary documents will be sent scanned by e-mail.
- By handing over goods to “AVE Bulgaria Logistics” OOD (or its representative), it is assumed that you have become familiar with these general terms and conditions and have agreed to their application.
- Upon receipt of a shipment, the recipient must check its condition in the presence of the representative of “AVE Bulgaria Logistics” Ltd., performing the delivery. In case of detection of a missing cargo or cargo damage, must be stated in the paper delivery confirmation or a note in the carrier’s road bill of lading, and in the case of electronic delivery confirmation. The absence of a note or a Report of lack/damage of cargo is proof that the shipment was received in the requested quantity and in good condition.
- For all issues not settled by these General Terms and Conditions regarding the liability of the carriers designated by “AVE Bulgaria Logistics” Ltd., the provisions of the Convention for the Unification of Certain Rules for International Carriage by Air (Montreal), ratified by the 39th National Assembly on 16.7.2003, in force from 9 January 2004, or the Warsaw Convention, shall apply, The Convention on the Contract for the International Carriage of Goods by Road (CMR), the Hague-Visby Rules or the Hamburg Convention in the case of sea transport or combined transport of consignments containing a sea leg where it cannot be proven on which leg the damage/loss occurred, the Convention on International Carriage by Rail (COTIF) Customs Convention on the International Carriage of Goods under Cover of Carnets (TIR), Agreement on the International Carriage of Perishable Foodstuffs and on the Special Means of Transport to be Used for Such Carriage (ATR), the Obligations and Contracts Act and the Commercial Act of the Republic of Bulgaria, as well as other norms of Bulgarian civil and commercial law relating to domestic and international transport and forwarding. The respective responsibilities are determined by the clauses written on the transport documents (air waybill, CMR, CIM, bill of lading), which constitute a contract of carriage for each delivery.
- In the event of a conflict between these General Terms and Conditions, other acts or separate agreements and the applicable legislative provisions, the latter shall apply. Bulgarian substantive law shall apply.
