TRANSPORT DOCUMENTS
Depending on the means of transport used, the following documents are to be filled in and presented to the customs authorities of the importing European Union (EU) Member State (MS) upon importation in order for the goods to be cleared:
Bill of Lading
The Bill of Lading (B/L) is a document issued by the shipping company to the operating shipper, which acknowledges that the goods have been received on board. In this way the Bill of Lading serves as proof of receipt of the goods by the carrier obliging him to deliver the goods to the consignee. It contains the details of the goods, the vessel and the port of destination. It evidences the contract of carriage and conveys title to the goods, meaning that the bearer of the Bill of Lading is the owner of the goods.
The Bill of Lading may be a negotiable document. A number of different types of bills of lading can be used. ‘Clean Bills of Lading’ state that the goods have been received in an apparent good order and condition. ‘Unclean or Dirty Bills of Lading’ indicate that the goods are damaged or in bad order, in this case, the financing bank may refuse to accept the consignor’s documents.
FIATA Bill of Lading
The FIATA Bill of Lading is a document designed to be used as a multimodal or combined transport document with negotiable status, which has been developed by the International Federation of Freight Forwarders Associations (FIATA).
Road Waybill (CMR)
The road waybill is a document containing the details of the international transportation of goods by road, set out by the Convention for the Contract of the International Carriage of Goods by Road 1956 (the CMR Convention). It enables the consignor to have the goods at his disposal during transportation. It must be issued in quadruplicate and signed by the consignor and the carrier. The first copy is intended for the consignor; the second remains in the possession of the carrier; the third accompanies the goods and is delivered to the consignee and the forth one must be signed and stamped by the consignee and then returned to the consignor. Usually, a CMR is issued for each vehicle.
The CMR note is not a document of title and is non-negotiable.
Air Waybill (AWB)
The air waybill is a document, which serves as a proof of the transport contract between the consignor and the carrier’s company. It is issued by the carrier’s agent and falls under the provisions of the Warsaw Convention (Convention for the Unification of Certain Rules relating to International Carriage by Air, 12 October 1929). A single air waybill may be used for multiple shipments of goods; it contains three originals and several extra copies. One original is kept by each of the parties involved in the transport (the consignor, the consignee and the carrier). The copies may be required at the airport of departure/destination, for the delivery and in some cases, for further freight carriers. The air waybill is a freight bill, which evidences a contract of carriage and proves receipt of goods.
A specific type of Air Waybill is the one used by all carriers belonging to the International Air Transport Association (IATA); a bill called the IATA Standard Air Waybill. It embodies standard conditions associated to those set out in the Warsaw Convention.
Rail Waybill (CIM)
The rail waybill (CIM) is a document required for the transportation of goods by rail. It is regulated by the Convention concerning International Carriage by Rail 1980 (COTIF-CIM). The CIM is issued by the carrier in five copies, the original accompanies the goods, the duplicate of the original is kept by the consignor and the three remaining copies by the carrier for internal purposes. It is considered the rail transport contract.
ATA Carnet
ATA (Admission Temporaire/Temporary Admission) carnets are international customs documents issued by the chambers of commerce in the majority of the industrialized world to allow the temporary importation of goods, free of customs duties and taxes. ATA carnets can be issued for the following categories of goods: commercial samples, professional equipment and goods for presentation or use at trade fairs, shows, exhibitions and the like. TIR Carnet
TIR carnets are customs transit documents used for the international transport of goods, a part of which has to be made by road. They allow the transport of goods under a procedure called the TIR procedure, laid down in the 1975 TIR Convention, signed under the auspices of the United Nations Economic Commission for Europe (UNECE).
The TIR system requires the goods to travel in secure vehicles or containers, all duties and taxes at risk throughout the journey to be covered by an internationally valid guarantee, the goods to be accompanied by a TIR carnet, and customs control measures in the country of departure to be accepted by the countries of transit and destination.

The insurance is an agreement by which the insured is indemnified in the event of damages caused by a risk covered in the policy. Insurance is all-important in the transport of goods because of their exposure to more common risks during handling, storing, loading or transporting cargo, but also to other rare risks, such as riots, strikes or terrorism.
There is a difference between the goods transport insurance and the carrier’s responsibility insurance. The covered risks, fixed compensation and indemnity of the contract of transport insurance are left to the holder’s choice. Nevertheless, the hauler’s responsibility insurance is determined by different regulations. Depending on the means of transport, indemnity is limited by the weight and value of the goods and is only given in case the transporter has been unable to evade responsibility.
CUSTOMS CLEARANCE REGIMES
Release for free circulation
The purpose of the release for free circulation procedure is to fulfil all import formalities so that the goods can be sold on the Union market.
Goods are released for consumption once all the import requirements have been met:
- All applicable tariff duties and other charges have been paid.
- Import licences for goods subject to quotas have been presented.
- All applicable authorisations and certificates (e.g. a veterinary certificate for certain animals or animal products) have been presented.
Imported goods are entered for the procedure by means of a customs declaration. The date on which this declaration is accepted by the customs office in an EU country is also the date that is taken into account for the calculation of the amount of import duty, value added tax and excise duty, if applicable.
Special procedures
Goods may be placed under any of the following treatments:
- Union Transit, which comprises:
- External transit – non-Union goods may be moved from one point to another within the customs territory of the EU without being subject to import duties, other charges related to the import of the goods (i.e. internal taxes) and commercial policy measures. Moving goods to another EU Member State means the customs clearance procedures are transferred to the customs office of destination.
- Internal transit – Union goods may be moved from one point to another within the customs territory of the EU without any change to their customs status. This includes transporting goods through another territory that is outside the EU customs territory.
- Storage, which comprises customs warehousing and free zones:
- Customs warehousing – non-Union goods may be stored in premises or any other location authorised by the customs authorities and under customs supervision (‘customs warehouses’) without being subject to import duties, other charges related to the import of the goods and commercial policy measures.
- Free zones – Member States may designate parts of the customs territory of the Union as free zones. They are where goods can be introduced free of import duties, other charges (i.e. internal taxes) and commercial policy measures, until they are either assigned another approved customs procedure or re-exported. Goods may also undergo simple operations such as processing and re-packing.
- Specific use which comprises temporary admission and end-use:
- Temporary admission – Non-Union goods can enter the EU without the payment of import duties, provided they are intended for re-export without being changed. The maximum period for temporary import is two years.
- End-use – goods may be released for free circulation under a duty exemption or at a reduced rate of duty on account of their specific use.
- Processing, which comprises inward and outward processing:
- Inward processing – Goods can be imported into the EU, without being subject to duties, taxes and formalities, to be processed under customs control and then re-exported. If the finished products are ultimately not exported, they become subject to the applicable duties and formalities.
- Outward processing – Union goods may be temporarily exported from the customs territory of the Union for processing purposes. The processed goods may be released for free circulation with total or partial relief from import duties.
HAZARDOUS CLASES
Hazardous goods by nature and degree of danger: classification
Class 1 – Explosives
Explosive materials that may explode or catch fire. And devices containing explosives and detonating means intended to produce a pyrotechnic effect
Subclasses
1.1 – pyrotechnic, explosive substances/products with a mass explosion hazard (instantaneous coverage of the entire cargo);
1.2 – pyrotechnic, explosive substances/products that do not explode in bulk;
1.3 – pyrotechnic, explosive substances/products that have a fire hazard with or without a slight explosive effect;
1.4 – pyrotechnic, explosive substances/products that carry a slight risk of explosion during transportation only in the case of initiation or ignition, which do not destroy devices and packages;
1.5 – explosives with a mass explosion hazard that are so insensitive that initiation or transition from combustion to detonation is unlikely during transportation;
1.6 – articles containing substances insensitive to detonation and characterized by a low probability of accidental initiation;
*Explosive mixtures of gases, vapours and dusts are not considered as explosives.
Class 2 – Gases
Compressed, liquefied by cooling and dissolved under pressure gases that meet at least one of the following conditions:
- absolute vapor pressure at 50 °C is equal to or higher than 3 kgf/cm2 (300 KPa);
- the critical temperature is below 50 °C.
According to the physical state of gases are divided into:
- Brief. The critical temperature is below -10 °C;
- Liquefied. The critical temperature is equal to or above -10 °C, but not lower than 70 °C;
- Liquefied. The critical temperature is equal to or above 70°C;
- Dissolved under pressure;
- Liquefied by supercooling;
- Aerosols and compressed gases that are subject to special regulations.
Subclasses
2.1 – non-flammable gases;
2.2 – non-flammable poisonous gases;
2.3 – flammable gases;
2.4 – flammable poisonous gases;
2.5 – chemically unstable;
2.6 – chemically unstable poisonous.
Class 3 – Flammable Liquids
Flammable liquids, mixtures of liquids, as well as liquids containing solids in solution or suspension, which emit flammable vapors with a flash point in a closed crucible at 61 °C and below.
3.1 – flammable liquids with a low flash point and liquids with a flash point in a closed crucible below -18 °C or having a flash point in combination with other hazardous properties other than flammability;
3.2 – flammable liquids with a medium flash point – liquids with a flash point in a closed crucible from -18 to +23 °C;
3.3 – flammable liquids with a high flash point – liquids with a flash point from 23 to 61 °C inclusive in a closed crucible.
Class 4 – Flammable Solids; Substances Liable to Spontaneous Combustion; Substances that Emit Flammable Gases on Contact with Water
Flammable liquids, mixtures of liquids, as well as liquids containing solids in solution or suspension, which emit flammable vapors with a flash point in a closed crucible at 61 °C and below.
3.1 – flammable liquids with a low flash point and liquids with a flash point in a closed crucible below -18 °C or having a flash point in combination with other hazardous properties other than flammability;
3.2 – flammable liquids with a medium flash point – liquids with a flash point in a closed crucible from -18 to +23 °C;
3.3 – flammable liquids with a high flash point – liquids with a flash point from 23 to 61 °C inclusive in a closed crucible.
Class 5 – Oxidizing Substances and Organic Peroxides
Oxidizing substances and organic peroxides, which can release oxygen, support combustion, and in certain conditions or mixtures with other substances cause spontaneous combustion and even explosion.
5.1 – oxidizing substances. They are not flammable in themselves, but contribute to the flammability of other substances and release oxygen during combustion, thereby increasing the fire intensity;
5.2 – organic peroxides. Most of them are flammable, can act as oxidizing agents and interact hazardously with other substances. Some of them are flammable and sensitive to impact or friction.
Class 6 – Toxic (Poisonous) and Infectious Substances
Poisonous and infectious substances that can cause poisoning, disease or even death.
6.1 – poisonous (toxic) substances that cause poisoning when inhaled (vapors, dust), ingested or in direct contact with the skin;
6.2 – substances and materials containing pathogenic microorganisms that are hazardous for humans and animals.
Class 7 – Radioactive Material
Radioactive substances with specific activity over 70 kBq/kg (nCi/g).
Class 8 – Corrosive Substances
Corrosive substances that cause damage to the skin, eyes, respiratory tract, cause corrosion of metals and damage vehicles, buildings, cargoes, and can also create a fire when interacting with organic materials or certain chemicals.
8.1 – acids;
8.2 – bases;
8.3 – caustic and corrosive substances.
Class 9 – Miscellaneous Dangerous Substances and Articles
Substances with a rather low hazard during transportation. They do not belong to any of the previous classes, but require certain rules for transportation and storage.
9.1 – solid, liquid combustible substances and materials that can become hazardous under certain conditions (flammable liquids with a flash point from +61 °C to +100 °C in a closed container, fibers and other similar materials);
9.2 – substances that become corrosive under certain conditions.
List of groups of particularly hazardous goods according to GOST 19433-88

- Flammable solids that self-decompose at a temperature not exceeding 50 °C with a risk of package rupture;
- Spontaneously combustible solids, poisonous;
- Flammable solids, caustic and/or corrosive;
- Substances emitting flammable gases when interacting with water, flammable;
- Substances emitting flammable gases when interacting with water, flammable and poisonous;
- Substances emitting flammable gases when interacting with water, flammable, caustic and/or corrosive;
- Oxidizing substances, poisonous, caustic and/or corrosive;
- Organic peroxides, explosive, self-decomposing at temperatures not exceeding 50 °C;
- Organic peroxides self-decomposing at temperatures above 50°C;
- Explosive organic peroxides;
- Organic peroxides without additional hazards;
- Organic peroxides are corrosive to the eyes;
- Organic peroxides, flammable;
- Organic peroxides, flammable, corrosive to the eyes;
- Poisonous substances, volatile, without additional hazards;
- Poisonous substances, volatile, flammable, with a flash point slightly above 23 °C;
- Poisonous substances, volatile flammable, with a flash point of more than 23 °C, but not exceeding 61 °C;
- Toxic substances, volatile, caustic and (or) corrosive;
- Caustic and (or) corrosive, acidic, toxic and oxidizing;
- Caustic and (or) corrosive, having acidic properties, oxidizing;
- Caustic and (or) corrosive, having acidic properties, poisonous;
- Caustic and (or) corrosive, having basic properties, flammable, with flash a point from 23 °C to 61 °C;
- Caustic and (or) corrosive, having basic properties, oxidizing;
- Caustic and (or) corrosive various, poisonous and oxidizing;
- Caustic and (or) corrosive various, flammable, with a flash point of not exceeding 23 °C;
- Caustic and (or) corrosive various, flammable, with a flash point from 24 °C to 61 °C;

In addition to this agreement, there are the other agreements for the transportation of hazardous goods in Europe:
IMDG is a contract for the carriage of hazardous goods by sea.
ICAO-TI is a contract for the carriage of hazardous goods by air.
RID is an agreement on the carriage of hazardous goods by rail. A special UN list of hazardous substances (containing more than 3000 items) has been created. Each hazardous substance included in this list has a four-digit identification number according to the UN list of hazardous substances. It can be used to find out the exact name of the hazardous substance being transported.
